General Terms and Conditions of Hotel Hamburg-Wittenburg van der Valk GmbH

General Terms and Conditions of Hotel Hamburg-Wittenburg van der Valk GmbH

Data Protection

The personal data specified in the contract, in particular name, address, telephone number and bank details, which are necessary and required solely for the purpose of implementing the contractual relationship arising, are collected on the basis of legal authorizations.
Any use of personal data beyond this and the collection of additional information generally require the consent of the data subject.

1. General Provisions

Offers and services are provided exclusively on the basis of these General Terms and Conditions, unless otherwise agreed in individual contracts.

The price lists published in each case and the conditions stated therein, which form part of the contract, shall apply. More recent price lists shall in each case invalidate the older price lists. alpincenter Hotel Hamburg-Wittenburg van der Valk GmbH is entitled to limit the sale of indoor facility admission tickets at any time. Booked services cannot be cancelled, and services not used will not be refunded unless otherwise agreed in these contractual terms and conditions. Both the provision and the frequency of use of the individual services from the all-inclusive offers depend on weather conditions and visitor frequency.

When purchasing bonus cards or course packages, a credit or extension shall only be granted if the customer is unable to continue using the services for health reasons, which must be proven by submitting a medical certificate. Only services not yet used shall be credited, less a processing fee of 10%. The relevant date is the date on which the certificate is submitted.

In the event of loss of cards (tickets), a new card for the period remaining from the date of submission for services not used will be issued upon presentation of the receipt and identity card. No replacement will be provided in the event of loss of the ticket/card and the receipt.
If the ticket and receipt are lost, the maximum possible use of the slope on that day at the time the loss is reported will be charged. If only the ticket is lost, billing will be calculated to the exact time upon presentation of the receipt.

alpincenter Hotel Hamburg-Wittenburg van der Valk GmbH (hereinafter referred to as alpincenter Hamburg-Wittenburg) reserves the right to restrict the use of season passes and other admission cards in individual cases due to special events (spatial and/or temporal restrictions).

When booking services pursuant to Sections II-III for groups (minimum 20 participants), the customer has the right to withdraw from the contract up to 1 day before the booked date. In the event of withdrawal, the following cancellation fees shall be due:
Up to 4 months before the booked date, free of charge
Up to 2 months before the booked date, 15% of the fee
Up to 1 month before the booked date, 30% of the fee
Up to 2 weeks before the booked date, 60% of the fee
up to and including the 2nd day before the booked date, 75% of the fee
Up to 1 day before the booked date or non-use on the day of the service, 90% of the fee
The customer is expressly entitled to prove that no damage at all, or substantially less damage than the flat rate, has been incurred.

alpincenter Hamburg-Wittenburg shall not be liable for force majeure. Liability for accidents of any kind, in particular insofar as they arise from sporting activities, or for other damage of any kind, except in the event of injury to life, body or health, shall apply if the damage is based on an intentional or grossly negligent breach of duty or a breach of traffic safety obligations for the facilities by alpincenter Hamburg-Wittenburg or its agents or vicarious agents.

alpincenter Hamburg-Wittenburg shall only be liable for theft and loss of personal property within the facility if the damage is based on an intentional or grossly negligent breach of contract.
Changes to contractual agreements must be made in writing. The customer consents to the contractual and billing data being kept in data collections insofar as this serves the proper execution of the contracts. Should individual provisions of these contractual terms and conditions be invalid, this shall not affect the validity of the individual contracts as a whole or of the remaining contractual terms and conditions. The place of jurisdiction is Hamburg, insofar as legally permissible.

1.1.    Online Ticket Booking

(1)    All information on the homepage and in the online ticket shop constitutes invitations to submit an offer. The visitor submits an offer to purchase a ticket by making the corresponding selection on the homepage of Hotel Hamburg-Wittenburg van der Valk GmbH or in the online ticket shop operated by it itself or by a third party commissioned by it.
(2)    Acceptance of the offer takes place by sending a purchase confirmation by email. This is sent immediately after receipt of the order and payment of the purchase price via a payment service provider. The email contains the corresponding tickets as a PDF attachment. The confirmation simultaneously constitutes proof of conclusion of the contract and of the contractual terms and conditions for the purchaser.
(3)    The visitor must independently ensure that the tickets are printed legibly or can be presented electronically, e.g. on a smartphone, at the entrance in a scannable manner. Tickets cannot be deposited at the ticket office. The date of validity is indicated on the ticket. Tickets may only be used once and each visitor requires their own ticket. The user of the ticket may differ from the purchaser and account holder printed on it, if applicable.
(4)    The ticket gives the visitor authorization to enter and use the facilities for the period indicated on the ticket. The contract concluded between the visitor and Hotel Hamburg-Wittenburg van der Valk GmbH through successful ticket booking therefore provides for a specific date for the contractual service, which is why a right of withdrawal for visitors is excluded pursuant to Section 312g (2) No. 9 German Civil Code (BGB).

2. Access to the Indoor Ski Facility and Use of Lift Facilities

Purchase of the alpincenter admission card entitles the customer to access the snow-covered area and use the lift facilities. A deposit fee is charged for all cards (except barcode tickets), which will be refunded upon return of the undamaged card. Access to the snow-covered area is only permitted with skis, snowboards or similar sliding equipment (except sledges) and appropriate clothing. Bringing in other items must be approved by alpincenter Hamburg-Wittenburg. Use of the lift facilities shall take place in accordance with the posted General Conditions of Carriage. Instructions from lift personnel must be followed.
Use of the ski facility is at the user's own risk and subject to compliance with alpincenter slope rules.
Waiting times caused by technical issues or visitor volume are possible and do not entitle the customer to cancel the booked service or claim a refund.
The alpincenter admission cards (hourly and daily tickets) are non-transferable and must be presented during any inspection. They remain the property of alpincenter Hotel Hamburg-Wittenburg van der Valk GmbH as reusable data carriers. In the event of misuse or resale, the card will be confiscated without compensation. alpincenter Hamburg-Wittenburg reserves the right to assert claims for damages.

3. Rental Equipment

Upon payment for the rental equipment, correct entry of personal data at the registration terminal and presentation of an identity card, the customer is entitled to rent the rental equipment paid for. Equipment will be issued while supplies last. The user is liable for the information provided by them.
All rental skis have high-quality safety bindings. All ski bindings are regularly checked to ensure that the release values correspond to the binding scale. Based on this, the personal setting value is determined according to age, gender, weight, height, skiing speed and skiing ability, and the setting is made manually taking into account the sole length of the ski boot. No individual electronic verification of the setting values is carried out. Snowboards and short skis are not equipped with safety bindings. All rental equipment is regularly inspected and complies with the respective current state of the art. The customer is responsible for putting on the equipment. Rental equipment must be returned after leaving the slope.
During their stay at alpincenter Hamburg-Wittenburg, users must take care of the rental equipment themselves. Any attempt to remove rental equipment from the building will result in criminal charges being filed without restriction – also in the interest of honest customers. In the event of damage, alpincenter Hamburg-Wittenburg is entitled to demand 50% of the replacement value of the rental equipment as flat-rate compensation. alpincenter Hamburg-Wittenburg reserves the right to prove greater damage. The customer is expressly entitled to prove that no damage at all, or substantially less damage than the flat rate, has been incurred.

4. Ski & Snowboard School

1. Organizer

The organizer is the alpincenter Ski & Snowboard School. The Ski & Snowboard School is part of Hotel Hamburg-Wittenburg van der Valk GmbH.

2. General

2.1 Participation in winter sports involves risks. Anyone taking part in offers of the alpincenter Ski & Snowboard School therefore agrees upon registration that participation (their own and that of all persons registered with them) is at their own risk and that, provided that the reasonable duty of care has been observed, the ski and snowboard instructors and responsible persons cannot be held liable.
2.2 Young persons under the age of 16 may only participate with an accompanying person or with the express consent of their parents.
2.3 Please have your own ski equipment checked at our sports shop of alpincenter Sporthandelsgesellschaft mbH before the course begins. A properly functioning and correctly adjusted safety binding with ski stoppers is particularly important. The instructors shall not be liable for damage resulting from incorrectly adjusted or defective equipment.
2.4 Each participant bears the risks typically associated with sporting activities themselves. Participants are advised to ensure that they have personal insurance coverage. In addition, accident insurance, personal liability insurance, daily sickness allowance insurance and occupational disability insurance are recommended.

3. Registration and Payment

3.1 Registration may be made in writing, by telephone, in person or online at www.alpincenter.com, subject to acceptance of these General Terms and Conditions.
3.2 The booking becomes binding only once it has been confirmed by the Ski & Snowboard School of alpincenter Hamburg-Wittenburg.
3.3 The registrant is the contractual partner for all persons listed in the registration and is liable for their obligations as well as their own.
3.4 Oral registrations are binding.

4. Services and Prices

4.1 The scope of contractual services is determined exclusively by the respective service descriptions in the printed program of the alpincenter Hamburg-Wittenburg Ski & Snowboard School and by the information on our homepage.
4.2 Ancillary agreements, in particular arrangements and additional requests by participants, require written confirmation. In the event of discrepancies in content between the printed program and information on the homepage, the printed program shall prevail.

5. Changes to Services and Prices

5.1 The alpincenter Hamburg-Wittenburg Ski & Snowboard School generally reserves the right to change the program if, due to exceptional circumstances, the courses cannot be held at the advertised times or at the advertised location.
5.2 Changes to services and prices before conclusion of the contract are expressly reserved, in particular in the event of printing errors and mistakes. Amendments and deviations of individual services from the contractual agreements that become necessary after conclusion of the contract are only permissible if they are not caused by the organizer contrary to good faith and do not otherwise impair the overall nature of the courses.
5.3 If the prices of one or more service providers have demonstrably and unforeseeably increased after conclusion of the contract, the organizer may also provide for price increases after conclusion of the contract to the extent that their increase per person affects the course price. In the event of price increases of more than 10% of the total price, the participant may withdraw free of charge.
5.4 Only one bonus price may be claimed per person. A combination of different bonus systems is not possible. The bonus price is only credited toward services used by the person entitled to the bonus themselves. It is granted only if the claim is stated in the registration. Subsequent reimbursements cannot be made.

6. Withdrawal by the Customer, Rebooking, Substitute Participant

6.1 You may withdraw up to 12 hours before the booked lesson. Otherwise, we reserve the right to charge a cancellation fee amounting to 50% of the booked lesson. The relevant date is the date of the postmark or the date of receipt in the case of electronic delivery.
6.2 If one or more persons are cancelled from a group booking, please note that, in addition to cancellation fees, additional costs may arise for the remaining participants. These additional costs shall be charged exclusively to the withdrawing participant (not applicable if an equivalent substitute participant is provided).
6.3 Under the statutory requirements of Section 651b German Civil Code (BGB) (transfer of contract), the participant may demand until the start of the course that a third party (substitute participant) enter into the rights and obligations of the course contract in their place. The organizer may object to the participation of the third party, in particular if they do not meet the special requirements of the offer or if their participation conflicts with legal regulations or official requirements. In the event of a transfer of contract, the joining course participant and the original course participant shall be jointly and severally liable for the course price (including additional and rebooking costs required by service providers) and for additional costs incurred by the transfer of contract at the alpincenter Hamburg-Wittenburg Ski & Snowboard School, such as administrative expenses, telephone, fax and postage costs, etc. The Ski & Snowboard School is entitled to charge these additional costs incurred by it at a flat rate of EURO 10.--.
6.4 There is no entitlement to make up missed course days or to a pro rata refund of costs.

7. Liability

7.1 The organizer shall be liable for the proper implementation of the courses booked with it in accordance with statutory provisions.

8. Withdrawal and Termination by the Organizer
8.1 The alpincenter Hamburg-Wittenburg Ski & Snowboard School generally reserves the right to withdraw if the minimum number of participants is not reached or exceptional circumstances occur, such as force majeure or closure of the lift facilities. Payments already made will be refunded in this case. Further claims are excluded.
8.2 After the course has commenced, the alpincenter Hamburg-Wittenburg Ski & Snowboard School is entitled to terminate the contract without notice if the participant persistently disrupts the conduct of the course despite a warning from the organizer, behaves in breach of contract to such an extent that immediate termination of the contract is justified, or if continuation of the contract would result in an unreasonable impairment of other participants. If the organizer terminates the contract, it retains the right to the course price; however, it must credit the value of expenses saved. Any additional costs arising from this shall be borne by the course participant.

5. Outdoor Funpark (Kart)

By purchasing and/or using participation tickets, including complimentary tickets, the participant expressly acknowledges that they enter, remain on and use the grounds, building and premises of the OUTDOOR FUNPARK of alpincenter Hamburg-Wittenburg Hotel Hamburg-Wittenburg van der Valk GmbH, as well as the facilities and their accessories (e.g. karts), exclusively and without restriction at their own risk and responsibility. By purchasing/using such tickets, the following limitation of liability is also acknowledged:
alpincenter Hamburg-Wittenburg Hotel Hamburg-Wittenburg van der Valk GmbH (hereinafter referred to as alpincenter Outdoor Funpark) assumes no liability for damage resulting from the operation of the karts and other outdoor equipment used or for damage caused by the operation of other vehicles, their drivers/users or conduct.
Entering and remaining in the premises of alpincenter Outdoor Funpark and participating in all activities is exclusively at one's own risk! Liability for any occurrence of damage is excluded. The exclusion of liability does not apply to damage caused by gross negligence or intent on the part of alpincenter Outdoor Funpark or its employees.
The participant assures that they have no physical ailments or influences (e.g. alcohol, drugs, medication) that could affect fitness to drive/participate. Particular attention is expressly drawn to the special danger for persons with heart problems and high blood pressure. The German Road Traffic Regulations also apply in this respect.
The participant bears civil and criminal liability for the karts driven by them and for any associated personal injury, property damage and financial loss. The participant shall indemnify alpincenter Outdoor Funpark upon first request against third-party claims against alpincenter Outdoor Funpark for compensation for damage caused by the participant. The participant waives claims for damages against alpincenter Outdoor Funpark or the organizer of the event unless there is gross negligence or intent.
Instructions from personnel must be followed. Helmets are mandatory when using the outdoor facilities.
The participant assumes unlimited liability for damage to the kart used by the participant caused by their own fault or the fault of third parties, by accident or improper handling, or resulting from the participant's failure to follow the instructions of alpincenter Outdoor Funpark employees.
